Significant Income Does Not Prevent a Bankruptcy Filing

When the laws changed in 2005 more emphasis was put on the income a person receives. When discussing your case with Ken Schneider, he will review your income with you to see if you fall above or below the median income for a household of your size. If you are above the median income you are considered to have "Significant Income". Some attorneys will recommend that you file a Chapter 13 just based upon your income figures. However, at the office of Ken Schneider, Attorney at Law, they will look further into your income and expenses to see if you could still qualify for a Chapter 7 even though you have "Significant Income".

Chapter 11/Business Bankruptcy

A lot of people are under the impression that when they own a business that they would need to file a Chapter 11 bankruptcy. That is not necessarily correct. Chapter 11 bankruptcy is much more complicated, and therefore more expensive, than either Chapter 7 or 13. Many times, through pre-bankruptcy planning, our clients are able to file Chapter 7 or 13 instead of Chapter 11.
